Terms and Conditions of Sale and Use

These terms apply to browsing the site and to any order for equipment, software licence, subscription, installation or training offered by Kmoove. Any order constitutes unreserved acceptance. These terms prevail over the buyer's own purchase conditions, unless otherwise agreed in writing.

The site is made available for information purposes. Technical descriptions, visuals and configurations are provided as a guide and may change. It is prohibited to extract, reproduce or reuse the site's content without written authorisation.

Prices are quoted on request, starting from €5,990 excl. VAT depending on configuration. A quote is valid for thirty days from its date of issue, unless stated otherwise. An order is firm upon receipt of the signed quote or the purchase order from the buying organisation, including through public purchasing bodies.

Two options coexist: purchase of the device, or a subscription including the equipment, catalogue updates and support. The duration, notice period and return conditions of the subscription option are set out in the accepted commercial proposal.

Prices are exclusive of tax, in euros, excluding delivery and installation costs unless stated otherwise. Unless otherwise agreed, payment is due within thirty days of the invoice date. Any late payment automatically incurs penalties at the statutory rate applicable between businesses and a flat recovery fee of €40.

Stated lead times are indicative and run from confirmation of the order. The buyer prepares the room: a clear projection surface, 220V power supply, sufficient clearance. No Wi-Fi connection is required for operation. Commissioning and staff training may be carried out on site or remotely, depending on the option chosen.

Equipment remains the property of Kmoove until the price has been paid in full. Risk transfers to the buyer upon delivery. Any reservation regarding the condition of the equipment must be noted with the carrier and confirmed to Kmoove within three business days.

The equipment carries a three-year warranty, extendable up to five years as an option. The warranty covers manufacturing defects, excluding damage caused by improper use, unauthorised modification or faulty electrical supply. Statutory warranties of conformity and against hidden defects remain applicable.

The buyer receives a non-exclusive, non-transferable right to use the software and the games catalogue, for the device supplied and for its internal use. Content created by the buyer using the Editor mode remains the buyer's property.

The processing of data is detailed in the privacy policy. The device operates without a user account and does not require any collection of health data.

Kmoove's liability is limited to the amount of the relevant order and excludes indirect damages. The buyer remains responsible for supervising the activities carried out with the device and for adapting sessions to participants' capabilities.

These terms are governed by French law. Failing an amicable resolution, jurisdiction is granted to the courts of the registered office of Kmoove SAS, in Lyon, subject to the mandatory rules applicable to public purchasers and consumers.
